Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Please Pause mobile application or visiting pleasepause.app (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Please Pause is a mindful phone launcher that requires you to write a brief reflection before opening gated apps. The Service includes a free tier with limited features and a paid Pro subscription with additional capabilities such as unlimited gated apps, extended history, and data sync.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Subscriptions & Billing

Please Pause Pro is available as a recurring subscription. All subscriptions are processed through Apple's App Store and managed by RevenueCat.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your Apple ID account settings.
  • Refunds are subject to Apple's refund policies.
  • Prices may change with reasonable notice. Continued use after a price change constitutes acceptance.

5. User Content & Ownership

You retain ownership of the reflections, responses, and other content you create through the Service ("User Content"). By using the Service, you grant Please Pause a non-exclusive, worldwide, royalty-free license to use your User Content solely for the purposes of operating, maintaining, and improving the Service.

You are solely responsible for your User Content. You represent that you have all rights necessary to grant the licenses described in these Terms and that your User Content does not violate any applicable law.

6. Anonymized Data

You acknowledge and agree that Please Pause may create anonymized, de-identified, and aggregated data derived from your use of the Service. This anonymized data cannot reasonably be used to identify you.

You agree that Please Pause may use, sell, license, distribute, and otherwise commercially exploit such anonymized and aggregated data for any lawful purpose without restriction, including but not limited to:

  • Training artificial intelligence and machine learning models
  • Academic and commercial research
  • Product development and analytics
  • Licensing or sale to third parties

7. Intellectual Property

The Service, including its design, code, branding, prompts, and all associated intellectual property, is owned by Please Pause and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

PLEASE PAUSE IS NOT A MEDICAL, THERAPEUTIC, OR MENTAL HEALTH SERVICE. THE REFLECTIONS AND PROMPTS PROVIDED ARE FOR PERSONAL MINDFULNESS PURPOSES ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF A QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS REGARDING A MEDICAL OR MENTAL HEALTH CONDITION.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLEASE PAUSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to ownership, disclaimers, limitations of liability, and the anonymized data clause.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

12. Changes to These Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
